So, what’s the difference between legal separation or divorce? Are you just putting off the inevitable? When are you separated and when do you become divorced? Can you have one without the other? Do you need to worry about the terminology?

So many questions which you may not think are relevant especially when you have just found out your wife is screwing her boss.Be assured, if you are like me, it was the last thing I wanted to be stressing over. However, they are important questions, and both are legally recognised entities so you need to pay close attention.

Hopefully, the information I have provided will act as a guide for you to better understand where it is you do in fact now stand.

Legal separation entails the formal recognition that a couple no longer wishes to live together as part of their marriage or civil partnership. It is important to note that legal separation is distinct from divorce; while divorce entails the complete dissolution of a marriage or civil partnership, legal separation allows a couple to live separately while still recognizing the legal status of their relationship.

Divorce is a legal process through which a marriage is legally terminated. It is the legal dissolution of a marital union, ending the legal obligations and responsibilities of the marriage.

Upon receiving the divorce petition, the respondent (the other party) has the opportunity to respond. They can either agree with the divorce or defend it. If the respondent defends the divorce, it can lead to a longer and more complex process. However, if they agree, they can complete and return the Acknowledgment of Service form to the court.

Step 4: Decree Nisi and Financial Disclosures

If both parties agree to the divorce, they can proceed to apply for a Decree Nisi. This is a document that states the court sees no reason why the couple cannot divorce. After this stage, both individuals must complete and exchange financial disclosure forms. This step helps to establish the financial agreement between the two parties involved.

Step 5: Decree Absolute

Once the financial issues are resolved, it's time to apply for the final decree of divorce, known as the Decree Absolute. This document formally ends the marriage. It is important to note that obtaining the Decree Absolute can take some time after the Decree Nisi has been granted. The period may vary depending on the circumstances, such as the court's backlog.
